PES Disclaimers

Pediatric Emergency Standards, Inc. (“PES”) does not make clinical or medical decisions. User’s use of the Handtevy Materials (the “Materials”) is not a substitute for its hiring and employment of competent, properly trained and knowledgeable staff that bring professional judgment and analysis to use of the Materials. It is the responsibility of User, its employees and contractors to exercise independent medical knowledge in making medical decisions on a case-by-case basis, and the Materials are intended to be used only as a guide. The term “User” means the buyer of the Materials, and its officers, directors, employees, agents, representatives and contractors.

The Materials are user-agnostic, and: (i) are based on established industry standards and/or nationally recognized guidelines for the treatment of children in the emergency medical context; (ii) are based on the experience of reputable, thought-leader institutions; and/or (iii) are supported by peer-reviewed clinical literature; AND (iv) are not sourced from or funded by pharmaceutical or other companies with a commercial interest in the content; AND (v) will be continuously updated by PES if established industry standards and nationally recognized guidelines evolve. PES has assembled the materials from third party sources. In so doing, PES has exercised reasonable due diligence and professional judgment in evaluating and selecting the Materials for inclusion.

The Materials must be customized by User prior to use based on its guidelines, protocols, drug options, drug concentrations, drug dosages, equipment size and other applicable factors (the “Customized Materials”). User must continuously ensure the accuracy of the Customized Materials based on changes to its guidelines, protocols, drug options, drug concentrations, drug dosages, equipment size and changes in nationally recognized guidelines. PES highly recommends prompt revision and updating of the Customized Materials to accommodate changes.

Furthermore, the age of a child may be used to determine a child's weight ONLY in children of average size. PLEASE NOTE that a length-based tape SHOULD be used on children of short or tall stature, or those with chronic illnesses.

Each User must exercise reasonable due diligence and professional judgment in determining whether to age or a length-based tape in assessing body weight. Such determinations must be based on various factors specific to user such as, without limitation, its guidelines, protocols, drug options, drug concentrations, drug dosages, equipment size and other factors.

USER CANNOT CONTROL THE FLOW OF DATA TO OR FROM ITS NETWORK AND OTHER PORTIONS OF THE INTERNET. SUCH FLOW DEPENDS IN LARGE PART, ON THE PERFORMANCE OF INTERNET SERVICE PROVIDERS OR THIRD PARTIES. AT TIMES, ACTIONS OR INACTIONS OF SUCH THIRD PARTIES MAY IMPAIR OR DISRUPT USER’S CONNECTIONS TO THE INTERNET (OR PORTIONS THEREOF). FOR THIS REASON, PES URGES THAT USER AND ITS MEDICAL PERSONNEL MAINTAIN HARD COPIES OF THE PES MATERIALS, OR MAINTAIN OTHER BACKUP OPTIONS IN THE FIELD AT ALL TIMES, IN THE EVENT THAT ACCESS TO ELECTRONIC VERSIONS OF THE PES MATERIALS IS INTERRUPTED OR UNAVAILABLE. ACCORDINGLY, PES DISCLAIMS ANY AND ALL LIABILITY RESULTING FROM OR RELATED TO SUCH EVENTS. EXCEPT FOR THE WARRANTIES SPECIFICALLY AND EXPRESSLY MADE HEREIN, PES MAKES NO WARRANTIES EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR WARRANTIES OF FITNESS, AND ALL SUCH WARRANTIES ARE DISCLAIMED.

Cancellation, Rescheduling, Refund, Lateness, No Show and Purchase Order Policies

The number of students in each class is limited based on proper student to teacher ratios; a place in the class has been reserved for you after completion of payment or through a signed purchase order (P.O.). We understand that situations beyond your control may arise that require cancellations or rescheduling. The following policies are necessary to maintain the quality of the Handtevy Courses.

Cancellations

Please provide 14 business days’ notice of a cancellation (Monday through Friday, 9:00AM to 5:00PM EST) before the date of the course; all cancellations MUST be in writing via email to Courses@Handtevy.com. Any cancellation made at 14 business days or more will be issued a refund or rescheduled at the discretion of the student.

Cancellations made within 7 to 13 business days (Monday through Friday, 9:00AM to 5:00PM EST) before the date of the course will be issued a course credit with the ability to reschedule for a future course date; within this timeframe the student will NOT be eligible for a refund. (Please see Reschedule policy)

Cancellations made within 1 to 6 business days (Monday through Friday, 9:00AM to 5:00PM EST) before the date of the course will not be issued course credit nor a refund, but will be allowed to substitute the reserved seat with another student. This transaction must be in writing: please send an email to Courses@Handtevy.com with the substitute copied in the email. Substitute’s failure to show up to the course will be handled as a NO SHOW, and the full course fee will be charged. (Please see No Show policy)

Rescheduling

In order to reschedule, you must contact Handtevy via email at Courses@Handtevy.com. Rescheduling will only be permitted to cancellations made within 7 or more business days (Monday through Friday, 9:00AM to 5:00PM EST) before the date of the course.

If contacted between 1 to 6 business days (Monday through Friday, 9:00AM to 5:00PM EST) before the date of the course will be allowed to substitute the seat with another student or forfeiture of the entire course fee. This transaction must be in writing: please send an email to Courses@Handtevy.com with the substitute copied in the email. Substitutes failure to show up to the course will be handled as a NO SHOW, and the full course fee will be charged. (Please see No Show policy)

Participant will be given ONE opportunity to reschedule, and it must be rescheduled within 90 days of the original class date or the next available class. Failure to appear on the rescheduled date will be considered a NO SHOW and forfeiture of the entire course fee.

Lateness

You must come to the course on time; please plan accordingly. It is recommended that students arrive to the course 15 minutes prior to the start. If you are expecting to be late to the course, this may be communicated to Courses@Handtevy.com.

If you are more than 30 minutes late to the course, you will not be allowed to participate in the course.

If you are within 30 minutes to 1 hour late to the start of the course, you will be eligible to reschedule according to the above policy. Please note this leniency is only applicable to students who made the attempt to come to the course but are too late to attend.

Students who are more than 1 hour late to the course start time will not be granted the privilege of rescheduling, resulting in a NO SHOW. (Please see No Show policy)

If you are late for a course that you rescheduled, you will be considered a NO SHOW. (Please see No Show policy)

No Show

Failure to appear in class or failure to notify via email to Courses@Handtevy.com (before 5:00 PM the business day before the course date) will be considered a NO SHOW. No shows will result in forfeiture of the entire course fee; no refunds, rescheduling, or substitutions will be permitted.

Payments made by Purchase Order (P.O.)

Payment by Purchase Order serves as a binding contract. The number of students granted through the P.O. must be equal to the number of students that attend the course. Failure to do so will result in a NO SHOW. (Please see No Show policy)

P.O.’s will be held liable to the aforementioned to Pediatric Emergency Standards, Inc.’s cancellation, rescheduling and no show policies. (Please see Cancellation, Reschedule, or No Show policies)

Full payment of the P.O. must be received in order to obtain credentials following the completion of the course.


Certified Instructor Agreement

This agreement between Pediatric Emergency Standards' Handtevy Corporate Training Center ("HCTC") and the undersigned ("Instructor") is intended to provide a clear understanding of HCTC’s expectations of the Instructor while he/she is affiliated with the HCTC. This agreement will remain in effect for the Initial Term of two (2) years, and must be renewed every two (2) years thereafter. This relationship is at will and may be terminated by HCTC or the Instructor at any time, with or without cause.

As a Certified Instructor of the Handtevy Pre-Hospital Pediatric Provider Course:

I understand and agree that I am obtaining the status of Certified Handtevy Instructor to provide a service for my department and am not authorized to charge a fee for the Handtevy Provider Course without written consent from Pediatric Emergency Standards, Inc. I agree to:

abide by all policies and procedures of HCTC program when conducting Handtevy training;

maintain high standards and professionalism while conducting all Handtevy training;

conduct all provider courses using only material approved for use by HCTC;

keep complete and accurate records of all Handtevy Pre-Hospital Pediatric Courses conducted and submit all provider course rosters and evaluations to HCTC within 14 days of course completion.

Ensure that all materials, equipment and supplies used when conducting a course are accounted for, sanitary, in good working order and that all written materials used are current; follow the curriculum for each course as set forth by HCTC (any deviations must be pre-approved by HCTC); ensure that sufficient materials, equipment and supplies are available for the number of students in attendance; notify HCTC of any change in instructor status or pertinent personal data; and acknowledge that I am not an employee of Handtevy-Pediatric Emergency Standards, Inc.

Certification Renewal Criteria

Required

Instructor candidates preferably have five (5) years of clinical experience and proficiency as an AHA or NAEMT Course Instructor, Field Training Officer (FTO), or Hospital Educator;

Submit the renewal fee to HCTC.

Recommended

Attend one (1) Handtevy Instructor Webinar per year;

Conduct or assist a minimum of one (1) Handtevy Pre-Hospital Pediatric Provider Course per year;

Submit a minimum of six (6) evaluations to the HCTC for each required course.
